WHO CAN GET A PATENT?

The process to get a patent starts off by having something that qualifies to be granted a U.S. patent according to U.S. patent law.

Utility patents are provided for a new, non-obvious and useful:

  • Process
  • Machine
  • Article of manufacture
  • Composition of matter
  • Improvement of any of the above

Note: In addition to utility patents, encompassing one of the categories above, patent protection is available for (1) ornamental design of an article of manufacture or (2) asexually reproduced plant varieties by design and plant patents.

After determining that your idea or invention is patentable, the next step is to file for a patent. the patent process can take anywhere from 8 months to 24 months. To be granted a Patent, you must have formal patent drawings and a list of other items prepared to file.
